Multiband Spearguns
OK in Baja
This
page contains images of two official documents that were generated by SEMARNAP,
who makes the laws, and PROFEPA, who administers the fishing laws in Mexico.
These important documents were obtained as interpretations to the most
recent Mexican Sportfishing Rules as they pertain to spearfishing. As there
was confusion to whether spearguns could have more than one rubber power
band, these documents verify that multiple rubber bands on a speargun are
permissible in Mexico (including the Sea of Cortez and vicinity around
Cabo San Lucas).
John M. Riffe worked
tirelessly and in close cooperation with Mexican officials to obtain their
interpretation of the laws pertaining to the legality of having multiple
rubber power bands on a speargun used in Mexican waters for sportfishing.
It is John M. Riffe's suggestion that divers have copy of each of
these
documents with them along with their Mexican Fishing Licence
and
Boat Permit when freediving for fish in Mexico (Sea of Cortez and waters
around Cabo San Lucas as well.). If a Mexican official questions your equipment,
have him read the Multiband OK documents and sign and date each documents
that he understands them. These signed documents may help get your spearfishing
equipment returned to you, if confiscated as illegal. Remember to know
and follow the Mexican Sportfishing Laws.

It is important to remember
that rumors of what is legal or illegal for persons of non-Mexican nationality
(tourists or resident aliens in Mexico) often is spouted as gospel by someone
who just wants to exploit the situation. Rumors of what is legal and what
is not are not up to the locals to decide.
